1. Introduction

Welcome to GIOCA.cloud, a platform for booking sports fields. These Terms and Conditions govern the use of the website https://gioca.cloud and the services offered by Fabio Biffi (hereinafter "GIOCA", "we", "us" or "our").

By using our website and services, the user fully accepts these Terms and Conditions. If you do not accept these terms, please do not use the site or services.

2. Definitions

  • "User" / "Client" / "You": the natural or legal person who uses the site and/or the booking services.
  • "Sports center": the sports facility that offers fields to book through the platform.
  • "Service": the online sports field booking platform.
  • "Booking": the request to use a sports field for a specific time slot.

3. Registration and Account

To make bookings, the user must register by providing truthful, complete and up-to-date information. The user is responsible for maintaining the confidentiality of their access credentials and for all activities carried out through their account. Registration is reserved for adults or minors assisted by a parent/guardian.

We reserve the right to suspend or delete an account in case of violation of these Terms, fraudulent use or provision of false information.

4. Bookings and Payments

Booking a sports field is done through the calendar available on the site. Confirmation of the booking is subject to payment of the indicated fee, unless otherwise agreed with the sports center.

Prices are expressed in CHF (Swiss francs) or EUR (euros), depending on the sports center, and include applicable taxes. Payment is processed through the payment providers indicated at the time of booking.

No-show or cancellation beyond the terms established by the sports center may result in the full amount being charged. Specific cancellation policies are indicated at the time of booking.

5. User Obligations

The user agrees to:

  • Use the service lawfully and in compliance with these Terms;
  • Not damage, tamper with or overload the site or platform systems;
  • Not use the service for fraudulent or illegal purposes;
  • Comply with the sports center rules when using the booked field;
  • Not attempt to access other users' accounts or restricted parts of the system.

6. Intellectual Property

Unless otherwise indicated, all content on GIOCA.cloud (texts, graphics, logo, images, software) is owned by Fabio Biffi or its licensors and is protected by copyright and intellectual property laws.

Reproduction, distribution, modification or publication of such content is prohibited without the written permission of the owner.

7. Limitation of Liability

GIOCA.cloud acts as an intermediary platform between users and sports centers. We are not responsible for:

  • The quality, availability or safety of the sports fields made available by the centers;
  • Any damages, injuries or losses suffered during the use of the sports fields;
  • The conduct of users or sports centers;
  • Service interruptions due to maintenance, force majeure or technical issues beyond our reasonable control.

Our total liability to the user is limited to the amount paid for the single booking that is the subject of the claim.

8. Withdrawal and Refunds

The user may request cancellation of a booking within the terms indicated at the time of the booking itself. Refund requests will be handled in accordance with the cancellation policy of the selected sports center.

For consumers based in the European Union, the right of withdrawal provided by applicable law applies, with the exclusion of services already performed (bookings already used).

9. Personal Data Protection

The processing of personal data is governed by our Privacy Policy, drawn up in compliance with the General Data Protection Regulation (GDPR - EU Reg. 2016/679) and the Swiss Federal Act on Data Protection (nFADP).

10. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be communicated via the site or by email. Continued use of the service after the changes take effect constitutes acceptance of the new terms.

11. Applicable Law and Jurisdiction

These Terms are governed by Swiss law. For any dispute arising from the use of the service, the competent court is that of Bellinzona, Switzerland, without prejudice to the mandatory protections provided for consumers by the law of their country of residence.
